歡迎使用「披薩多益」(Pizza TOEIC,以下簡稱「本 App」)。 當你下載、安裝或使用本 App 時,即表示你已閱讀、理解並同意遵守本使用條款。 若你不同意本條款,請勿使用本 App。

一、服務說明

本 App 是一款協助使用者學習多益(TOEIC)英文單字的行動應用程式, 提供單字背誦、答題練習、發音播放與學習進度紀錄等功能。 我們可能不定期新增、調整或移除部分功能。

二、授權範圍

在你遵守本條款的前提下,我們授予你一項有限、非專屬、不可轉讓、 可撤回的授權,供你在自有裝置上將本 App 用於個人、非商業之學習用途。你不得:

三、App 內購買與退款

本 App 提供免費版與付費的「無上限版」。購買付費功能時, 款項由 Apple App Store 或 Google Play 商店處理,並依你所使用商店的 帳號與付款方式扣款。

退款事宜一律依 Apple 或 Google 商店的退款政策辦理, 並非由本 App 直接受理。如需申請退款,請透過你購買時所使用的商店提出。 部分付費為訂閱制者,續訂與取消亦依商店規則辦理。

四、免責聲明

本 App 所提供的學習內容僅供輔助學習之用, 我們會盡力確保內容正確,但不保證其完全無誤、即時或適用於你的個別需求。本 App 不保證你使用後必能提升多益成績或達到特定分數。本 App 依「現況」與「現有」基礎提供,在法律允許的最大範圍內, 我們不就其適售性、特定用途適用性或不侵權作任何明示或默示擔保。

五、智慧財產權

本 App 及其內含之文字、單字資料、例句、音檔、介面設計、商標與軟體, 均為我們或授權人所有,受著作權法及相關法令保護。 除本條款明確授予之權利外,你不會取得任何其他權利。

六、服務變更與終止

我們保留隨時新增、修改、暫停或終止本 App 全部或部分服務的權利, 且無須事先個別通知。若你違反本條款,我們得隨時終止對你的授權。 服務終止後,本條款中依其性質應繼續有效之條款(如免責聲明、 智慧財產權)仍持續適用。

七、準據法與管轄

本條款之解釋與適用,以及因本 App 所生之爭議,均以中華民國法律為準據法。 因本條款所生之爭議,雙方同意以臺灣臺北地方法院為第一審管轄法院。

English Version (Terms of Service)

Welcome to “披薩多益” (Pizza TOEIC, the “App”). By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

1. Description of Service

The App is a mobile application that helps users learn TOEIC English vocabulary, offering features such as vocabulary study, quiz practice, audio pronunciation, and learning-progress tracking. We may add, modify, or remove features from time to time.

2. Scope of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own for personal, non-commercial learning purposes. You may not:

  • Use the App or its content for any commercial sale, resale, or distribution.
  • Reverse engineer, decompile, crack, or attempt to obtain the source code of the App.
  • Remove or alter any copyright, trademark, or other proprietary notices in the App.
  • Use any bot, scraper, or other automated means to extract content in bulk.

3. In-App Purchases and Refunds

The App offers a free version and a paid “Unlimited” version. When purchasing paid features, payment is processed by the Apple App Store or Google Play Store and charged to the account and payment method associated with your store.

All refunds are handled according to the refund policies of the Apple or Google store and are not processed directly by the App. To request a refund, please do so through the store you used to make the purchase. For subscription-based purchases, renewal and cancellation are also governed by the store’s rules.

4. Disclaimer

The learning content provided by the App is for supplementary learning purposes only. While we strive to ensure accuracy, we do not guarantee that it is entirely error-free, current, or suitable for your individual needs. The App does not guarantee that your TOEIC score will improve or reach any particular level. The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no express or implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. Intellectual Property

The App and all text, vocabulary data, example sentences, audio, interface design, trademarks, and software contained within it are owned by us or our licensors and are protected by copyright and related laws. Except for the rights expressly granted in these Terms, you acquire no other rights.

6. Changes to and Termination of Service

We reserve the right to add, modify, suspend, or terminate all or part of the App’s service at any time without prior individual notice. If you violate these Terms, we may terminate your license at any time. After termination, provisions that by their nature should survive (such as the disclaimer and intellectual property clauses) will continue to apply.

7. Governing Law and Jurisdiction

These Terms, their interpretation and application, and any disputes arising from the App are governed by the laws of the Republic of China (Taiwan). The parties agree that the Taiwan Taipei District Court shall be the court of first instance for any disputes arising from these Terms.
